These Terms and Conditions ("Terms") govern your access to and use of forbayai.com and any purchase of goods from FORBAY LTD. By placing an order or using our website you agree to these Terms. Please read them carefully. Nothing in these Terms affects your statutory rights as a consumer.
1. About us
forbayai.com is operated by FORBAY LTD, a company registered in England & Wales (company number 16976893) with its registered office at 128 City Road, London, EC1V 2NX, United Kingdom.
2. Eligibility and account
You must be at least 18 years old and capable of forming a binding contract to place an order. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorised access.
3. Orders and contract formation
Your order constitutes an offer to purchase goods from us. We will confirm receipt of your order by email. A binding contract is formed only when we dispatch the goods and send a dispatch confirmation email. We reserve the right to refuse or cancel any order, for example where stock is unavailable, where there is a pricing error, or where we suspect fraud.
4. Prices and payment
All prices are shown in the currency selected at checkout and include VAT where applicable. Delivery charges are shown separately before you confirm your order. Payment is taken at the point of order confirmation through our PCI-DSS compliant payment processor. We do not store full card details.
5. Delivery
Delivery times and costs are set out in our Delivery Policy. Risk in the goods passes to you on delivery. Title passes to you once we have received payment in full.
6. Right to cancel (consumers)
Under the Consumer Contracts Regulations 2013, UK consumers have the right to cancel a purchase within 14 days of receipt without giving a reason. Please see our Refund Policy and Return Policy for instructions. Certain items (such as custom orders, opened hygiene products and sealed cleaning solutions) are exempt from the statutory right of cancellation.
7. Warranty and conformity
Goods are guaranteed to match their description and to be of satisfactory quality and fit for purpose. In addition, FORBAY products carry a 2-year limited manufacturer warranty as set out in our Warranty Policy. Your statutory rights under the Consumer Rights Act 2015 are not affected.
8. Acceptable use
You agree not to misuse our website, attempt to gain unauthorised access, transmit malicious code, scrape content for commercial purposes, or use the site in a way that violates applicable law or infringes third-party rights.
9. Intellectual property
All content on forbayai.com — including text, graphics, logos, images, product designs and software — is owned by or licensed to FORBAY LTD and is protected by intellectual property laws. You may not reproduce, distribute, modify or create derivative works without our prior written consent.
10. Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under English law. Subject to that, our total liability arising out of or in connection with the supply of goods is limited to the price you paid for those goods.
11. Force majeure
We are not liable for failure to perform any obligation under these Terms where such failure results from events outside our reasonable control, including but not limited to natural disasters, war, civil unrest, acts of government, industrial action, supplier failures or interruptions to internet or power services.
12. Governing law and jurisdiction
These Terms and any contract formed under them are governed by the laws of England & Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England & Wales, save that consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.
